SuperiorGlacier Executive Named By Federal Judge To Provide ESI Discovery

New York, October 15, 2007 -- SuperiorGlacier's Tom Tigh, serving as an electronic discovery expert witness in a federal court action in Tennessee on behalf of more than 550,000 children deprived of medical services, has been named to oversee defendants' court-ordered production of electronically stored information (ESI). In his Order in the Tennessee action, United States District Judge William J. Haynes, Jr. stated that Mr. Tigh, or a designee of his choosing, is to be present for the defendants' production of ESI, and is to inspect the defendants' computer system to assess whether any changes to that system that would hinder production have occurred. In the 187 page Memorandum accompanying his Order, Judge Haynes repeatedly cited Mr. Tigh's expert testimony in support of his decision compelling production by defendants.

The case, John B v. Goetz, is a class action on behalf of children deprived of medical services to which they were entitled under federal law and a 1998 Consent Decree. Represented by the Tennessee Justice Center and private law firms working pro bono, plaintiffs sought various data which the defendants ¬ three Tennessee state agencies ¬ repeatedly refused to produce. SuperiorGlacier's Tom Tigh joined the pro bono effort as an expert to address the defendants’ failure to produce ESI.
